Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and TARTINE BAKERS LLC, a company operating under the laws of the State of New York, governing your use of the Zesty Flowers website at https://zestyflowers.com/recipes/ ("Site"). Please read them carefully before using the Site.

1. Acceptance of Terms

By accessing or using the Site, creating an account, or making a purchase, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Membership Subscriptions

Free Trial: All new subscriptions include a 30-day free trial period. During this period you will not be charged. Your payment method will be charged on day 31 unless you cancel before the trial ends.

Monthly Subscriptions: Monthly memberships are billed on the same calendar date each month (or the last day of the month if the original date does not exist in a given month). Your card will be charged automatically at the then-current monthly rate of $12.99 until you cancel.

Annual Subscriptions: Annual memberships are billed once per year on the anniversary of your subscription start date at the then-current annual rate of $99.99.

Auto-Renewal: Subscriptions auto-renew automatically. You authorise us to charge your payment method on file at each renewal date. We will notify you by email at least 5 days before your annual renewal.

Cancellation: You may cancel your subscription at any time by emailing hello@zestyflowers.com. Cancellation takes effect at the end of your current billing period. You retain access to premium content until that date. Cancellation during a free trial results in no charge. After billing begins, a 30-day money-back guarantee applies as described in our Refund Policy.

Price Changes: We may change subscription prices. We will provide at least 30 days' notice by email before any price change takes effect on your account.

3. Permitted Use

You may use the Site for your personal, non-commercial purposes only. You may not reproduce, distribute, sell, or sublicense any content from the Site without our prior written permission. You may not use automated tools (scrapers, bots) to access or copy content from the Site.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access at hello@zestyflowers.com. We are not liable for any loss resulting from unauthorized use of your account.

5. Intellectual Property

All content on the Site -- including recipes, photographs, text, graphics, software, and design -- is owned by or licensed to TARTINE BAKERS LLC and is protected by copyright, trademark, and other intellectual property laws. Your membership grants you a personal, non-transferable, non-exclusive licence to access and view this content for personal use only. Nothing in these Terms transfers any intellectual property rights to you.

6. Disclaimer of Warranties

The Site and all content are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, TARTINE BAKERS LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Site. Our total liability to you for any claim shall not exceed the greater of $100 or the amount you paid us in the 12 months preceding the claim.

8. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved informally by contacting us at hello@zestyflowers.com.

Binding Arbitration: If informal resolution fails, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in New York. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

9. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Site and, for registered users, by email. Your continued use of the Site after the effective date of the change constitutes acceptance of the revised Terms.
