These Terms of Service ("Terms") govern your use of the Zesty Flowers website and services operated by TARTINE BAKERS LLC. By using our Site or placing an order, you agree to these Terms.

1. Orders and Products

All orders are subject to acceptance and availability. We reserve the right to refuse any order. Prices are shown in USD and are subject to change without notice. We make reasonable efforts to accurately represent our products; however, actual flower colours and arrangements may vary slightly due to the natural variability of fresh flowers and seasonal availability.

2. Subscription Billing

The Flower Box subscription is a recurring billing service. By subscribing, you authorise us to charge your payment method on a monthly or annual basis (as selected) beginning after your free trial period ends. Your first box is free; billing commences after the first delivery. We will notify you by email before each billing cycle.

3. Free Trial

New subscribers receive their first Flower Box free of charge. The free trial is limited to one per customer. After the free trial, your subscription will automatically renew at the applicable plan rate unless cancelled prior to the renewal date.

4. Cancellation

You may cancel your subscription at any time by emailing hello@zestyflowers.com. Cancellations must be received before the next billing date to avoid being charged for the following period. No partial refunds are provided for unused portions of a billing period. Annual subscribers who cancel within 30 days of their first payment are eligible for a full refund under our money-back guarantee.

5. Intellectual Property

All content on this Site, including text, images, logos, and design elements, is the property of TARTINE BAKERS LLC or our licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TARTINE BAKERS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved by binding individual arbitration conducted by the American Arbitration Association under its Consumer Arbitration Rules. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Site after any changes constitutes acceptance of the revised Terms.
